In addition to the regular calendar, a district must designate at least five contingency days to be utilized in the case where the number of calamity days exceeds the statutorily allowed amount. Prior to September 1, a resolution specifying a contingency plan under which the district's students will make up days in excess of the 5 "calamity" days that can be waived by the Superintendent of Public Instruction must be adopted by the district board of education. The resolution shall provide a plan for making up at least five full school days. (RC Section 3313.482) The resolution shall not conflict with any collective bargaining agreement that is in effect in the district. (RC Section 3313.482(A)). Many school districts will include holidays as part of their contingency plan. This is acceptable. However, if calamity days occur in excess of the five authorized by law, and the designated contingency days have passed, a district still must make up the excess calamity days. |
